1. Acceptance of Terms
These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Picsora ("we," "us," or "our") governing your access to and use of the Picsora mobile application, website (picsora.in), and all related services (collectively, the "Services").
By downloading the App, creating an account, or accessing any part of our Services, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.
If you do not agree to these Terms, you must not use our Services. If you are accepting these Terms on behalf of an organisation (e.g., a photography studio), you represent that you have the authority to bind that organisation to these Terms.
2. Description of Service
Picsora is an AI-powered photo-sharing platform designed for photographers, studios, and event guests. The Services include:
- For Guests: Joining events via QR code or invite link, creating a Face Profile to auto-discover your photos using AI facial recognition, viewing and downloading event photos, and managing favourites.
- For Studios & Photographers: Creating and managing events, uploading and organising event photos, managing guest access, creating and sharing studio portfolios, handling client quotations through an AI-assisted quotation system, and accessing analytics.
- Platform Features: OTP-based phone authentication, push notifications, cloud storage for photos, a support ticket system, and subscription plan management.
We reserve the right to modify, suspend, or discontinue any feature or aspect of the Services at any time, with or without notice, and we will not be liable to you or any third party for any such changes.
3. Eligibility
To use Picsora, you must:
- Be at least 13 years of age. If you are between 13 and 18, you must have parental or guardian consent.
- Have a valid mobile phone number capable of receiving SMS.
- Have the legal capacity to enter into a binding contract under applicable law.
- Not be prohibited from using the Services under the laws of your jurisdiction.
Studio accounts used for commercial purposes require users to be at least 18 years of age and have the legal authority to enter into commercial agreements.
4. User Accounts
4.1 Registration
Account registration requires a valid mobile phone number. We authenticate you via OTP (One-Time Password) delivered by SMS. You are responsible for ensuring the accuracy of your phone number.
4.2 Account Security
You are responsible for maintaining the confidentiality of your account session and for all activities that occur under your account. You must notify us immediately at contact@picsora.in if you suspect any unauthorised use of your account.
4.3 One Account Per User
Each phone number may be associated with one user account. Creating multiple accounts to circumvent restrictions, subscription limits, or platform policies is prohibited.
4.4 Account Accuracy
You agree to provide accurate, current, and complete information and to keep it updated. Providing false or misleading information may result in suspension or termination of your account.
5. User Conduct
As a user of Picsora, you agree to:
- Use the Services only for lawful purposes and in accordance with these Terms.
- Only upload selfies or photos of yourself to your Face Profile - not photos of other people without their explicit consent.
- Respect the privacy and dignity of all individuals who appear in event photos.
- Not share, reproduce, or commercially exploit event photos without the permission of the photographer or studio who uploaded them.
- Not attempt to access photos from events you are not authorised to join.
- Provide accurate information when submitting quotation enquiries or interacting with studios.
6. Studio / Photographer Terms
6.1 Studio Account Responsibilities
If you register as a studio or photographer on Picsora, you accept additional responsibilities:
- You must have the legal right to upload and distribute all photos added to the platform. By uploading photos, you represent that you hold the necessary rights and permissions, including model releases where required.
- You are responsible for communicating to event guests that AI facial recognition technology may be used to identify and deliver their photos.
- You must honour all quotation commitments made through the platform in good faith.
- You are solely responsible for the pricing, deliverables, and contractual obligations stated in quotations sent to clients.
- You must not upload photos that are defamatory, obscene, illegal, or that violate the rights of any person.
6.2 Event Management
Studios control event access settings, including whether events are public or restricted. You are responsible for managing guest access appropriately. Picsora is not liable for photos accessed by guests you have authorised or for events misconfigured by the studio.
6.3 Portfolio
Studio portfolios displayed on Picsora are public-facing. You are responsible for the accuracy of your portfolio content, including your stated services, pricing, and contact information.
7. Biometric Data Consent
By creating a Face Profile in the Picsora App, you expressly consent to:
- The collection and processing of your facial geometry data (biometric identifier) through our AI face recognition system.
- The use of your face embedding to match and surface your photos across events you are authorised to access.
- The storage of your face embedding and uploaded selfie photos on our secure cloud infrastructure.
You may withdraw this consent at any time by deleting your Face Profile photos within the App. Withdrawal of consent will disable AI photo matching but will not otherwise affect your access to Picsora's other features.

8. Intellectual Property
8.1 Picsora Platform
All rights, title, and interest in and to the Picsora platform, including but not limited to software, design, trademarks, logos, AI models, and all other content created by Picsora, are and shall remain the exclusive property of Picsora. Nothing in these Terms grants you any right to use the Picsora name, logo, or brand identifiers.
8.2 User Content
You retain all intellectual property rights in the photos and content you upload to Picsora. By uploading content, you grant Picsora a non-exclusive, worldwide, royalty-free licence to store, process, display, and deliver your content solely for the purpose of operating and improving the Services.
We will not use your photos for advertising, training external AI models, or any purpose beyond operating the Services without your explicit consent.
8.3 Feedback
If you provide us with suggestions, ideas, or feedback, you grant Picsora a perpetual, irrevocable, royalty-free licence to use such feedback for any purpose without obligation to you.
9. Subscriptions & Payments
9.1 Studio Subscription Plans
Picsora offers subscription plans for studios and photographers granting access to premium features including increased storage, advanced analytics, custom branding, and more. Plan details, pricing, and feature inclusions are listed on our Pricing page.
9.2 Free Trial
New studio accounts receive a free trial period as stated at the time of registration. At the end of the trial, your account will be downgraded to the free tier unless you subscribe to a paid plan.
9.3 Billing
- Subscription fees are billed in advance on a monthly or annual basis, as selected.
- Payments are processed through our payment partner. By subscribing, you authorise us to charge your payment method.
- All fees are stated in Indian Rupees (INR) and are inclusive of applicable taxes unless stated otherwise.
9.4 Cancellations and Refunds
You may cancel your subscription at any time from the account settings. Cancellation takes effect at the end of the current billing period. We do not provide pro-rated refunds for partial billing periods unless required by applicable law or in cases of technical error on our part.
9.5 Price Changes
We reserve the right to modify subscription pricing with at least 30 days' notice. Continued use of the Services after the effective date of the price change constitutes your acceptance of the new pricing.
10. Prohibited Activities
You must not use Picsora to:
- Upload or share content that is illegal, defamatory, obscene, harassing, threatening, or violates the rights of any third party.
- Attempt to identify, track, or surveil any individual without their knowledge or consent using our facial recognition features.
- Upload photos of minors without the explicit consent of their parent or legal guardian.
- Scrape, crawl, or systematically extract data from the platform without authorisation.
- Reverse engineer, decompile, or attempt to extract the source code of our application.
- Circumvent, disable, or interfere with security features, authentication systems, or access controls.
- Use the platform for spam, phishing, or any fraudulent activity.
- Impersonate another person or entity.
- Violate any applicable local, national, or international law or regulation.
Violation of these prohibitions may result in immediate account suspension, permanent termination, and/or legal action.
11. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
- We do not warrant that the Services will be uninterrupted, error-free, or free of viruses or other harmful components.
- AI face matching accuracy is dependent on photo quality, lighting conditions, and angle. We do not guarantee 100% accuracy and are not liable for missed or incorrect photo matches.
- We are not responsible for the content uploaded by studios or photographers, including the accuracy of event photos.
- We do not endorse any studio, photographer, or service listed on the platform.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PICSORA AND ITS DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of data, photos, or business opportunities.
- Errors or inaccuracies in AI face matching results.
- Unauthorised access to your account resulting from your own negligence.
- Actions or omissions of third-party studios or photographers.
- Service interruptions or downtime.
Our total aggregate liability to you for any claims arising under these Terms shall not exceed the amount you paid to Picsora in the 3 months immediately preceding the claim, or ₹1,000 (INR), whichever is greater.
13. Indemnification
You agree to indemnify, defend, and hold harmless Picsora and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with:
- Your violation of these Terms.
- Your use of the Services in a manner not authorised by these Terms.
- Content you upload, share, or otherwise make available through the Services.
- Your violation of any third-party rights, including intellectual property or privacy rights.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. The platform and Services are operated from India, and applicable laws include but are not limited to:
- The Information Technology Act, 2000 and its amendments.
- The Digital Personal Data Protection Act, 2023 (DPDPA).
- The Consumer Protection Act, 2019.
15. Dispute Resolution
In the event of any dispute, claim, or controversy arising out of or relating to these Terms or the Services, the parties agree to first attempt to resolve the matter through good-faith negotiation.
If the dispute cannot be resolved through negotiation within 30 days, it shall be submitted to binding arbitration in accordance with the Arbitration and Conciliation Act, 1996. The arbitration shall be conducted in English, and the seat of arbitration shall be in India.
Nothing in this clause prevents either party from seeking urgent injunctive or interim relief from a court of competent jurisdiction.
16. Termination
16.1 Termination by You
You may delete your account at any time via the App (Profile → Settings → Delete Account) or by visiting our Account Deletion page. Upon deletion, these Terms will cease to apply except for provisions that, by their nature, should survive (including Sections 8, 11, 12, 13, 14, and 15).
16.2 Termination by Picsora
We may suspend or terminate your account immediately if you violate these Terms, engage in prohibited activities, or if we are required to do so by law. We will endeavour to notify you of the reason for termination where permitted by law.
16.3 Effect of Termination
Upon termination, your right to use the Services ceases immediately. We will delete your account data in accordance with our Data Retention Policy. Subscription fees already paid are non-refundable upon termination for cause.
17. Changes to Terms
We may revise these Terms at any time. When we make material changes, we will update the "Last updated" date and notify you via in-app notification or email (if provided). Your continued use of the Services after the effective date of any changes constitutes your acceptance of the revised Terms.
If you do not agree to the revised Terms, you must stop using the Services and delete your account.
